Obama's War with the Senate through the Courts

Open Email to Senate Republicans:
Pres. Obama has had some difficulty in allowing excessive control measures by some of his agencies. For example, the Washington Times says one panel of the Seventh Circuit Court of Appeals in Washington DC last year struck down a move by the Environmental Protection agency to regulate air pollution across state lines. Another panel ruled in January that Mr. Obama exceeded his powers when he made recess appointments to the National Labor Relations Board.
The DC Court has four Democratic and for Republican appointees. To alleviate his problem with this court, Pres. Obama has nominated three more Democratic appointees, which would give a total of seven Democrats and four Republicans.
Nominations to the DC Circuit Court require Senate approval. In effect, Pres. Obama is daring the Republicans to block the nominations. Pres. Obama has been engaged in a war against Congressional Republicans for some time and only recently have Congressional Republicans recognized the situation. With the present challenge, Congressional Republicans must accept the fight. They can block the nominations by filibuster, which I strongly suggest they use. Congressional Democrats have threatened to use what they call a nuclear option of outlawing the filibuster. I suggest Congressional Republicans accept this challenge as well, since it is likely a bravado statement on the part of the Democrats. They have as much to lose as the Republicans in a filibuster ban.
